JAM Arena – West Flagler Associates
Introduction
JAM Arena and West Flagler Associates would like to inform you that certain events may contain flashing lights, strobe effects, loud noises, or other production elements which may cause difficulties for people with photosensitive epilepsy or other medical sensitivities. Please consider this factor when purchasing tickets.
This is a legal document that describes your rights and responsibilities as a user, including important information on the purchase of tickets.
When reference is made to this "Agreement," it shall include this Purchase Agreement, any supplemental terms, venue rules, terms and conditions, privacy policy, and any applicable state privacy rights policies (collectively, the "Website Policies"), as applicable. West Flagler Associates may modify the Website Policies in effect during your use of this website. In the event of a discrepancy between this Purchase Agreement and the Website Policies, this Purchase Agreement shall prevail.
Tickets purchased through JAM Arena's official website are tickets sold directly by West Flagler Associates to the Customer. Such sale transactions are subject to and hereby incorporate the legally binding terms and conditions set out in this Agreement.
Tickets purchased through a third-party retailer are sold directly by such third-party retailer to the Customer. For such transactions, only the terms of this Agreement which are not inconsistent with the third-party retailer's purchase and website terms and conditions (if any) shall apply.

Conditions of Sale and Contractual Obligations
The parties to this Agreement are:
WEST FLAGLER ASSOCIATES, operator of JAM Arena, with its principal place of business in the State of Florida ("West Flagler Associates" or "JAM Arena")

You (also referred to as the "Customer")
Conclusion of Contract and Order Confirmation
You hereby agree to purchase and West Flagler Associates agrees to sell the ticket(s) detailed in your order. Once your order is confirmed and payment is completed, you will be redirected to a page indicating a confirmation number. Please retain this number for your records. You will also receive an email confirming your order.
If you are not redirected to the confirmation page or do not receive a confirmation number, it is your responsibility to contact JAM Arena to confirm whether your order was processed.
Should there be an error or inaccuracy in processing the order, or should a payment processor reject the transaction, a representative of West Flagler Associates may attempt to contact you using the information provided at the time of purchase. If West Flagler Associates is unable to reach you after an initial attempt, or if the transaction is rejected, West Flagler Associates reserves the right to cancel your order and sell the tickets to another customer. In such case, you will be notified using the contact information you provided.
Service Fees and Facility Fees
You understand that tickets purchased through this website may be subject to non-refundable per-ticket or per-order service fees and/or facility fees.
Delivery
In some circumstances, tickets purchased through this website may be delivered electronically by email, mobile ticketing, or made available for will-call pickup, depending on the event and delivery option selected.
If you choose electronic delivery, you must present your ticket(s) on a mobile device or as printed copies, unless otherwise instructed.
Obligation to Pay
You agree to pay the full price of the tickets ordered, including any applicable taxes, service fees, facility fees, delivery fees, and any other costs disclosed during the purchase process.
No Refunds or Exchanges
Except as otherwise provided by this Agreement or applicable law, tickets are non-refundable, non-exchangeable, and not redeemable for cash. Please carefully review your ticket selection before completing your order.
Cancelled and/or Postponed Events
West Flagler Associates may, at its sole discretion, cancel or postpone an event. You will receive notice of such cancellation or postponement. In such cases, West Flagler Associates may offer tickets for a rescheduled date or a refund, as determined by JAM Arena.
Late Arrivals
Events start on time. Late arrivals may be admitted only at an appropriate break or at the discretion of venue staff.
Right to Cancel Tickets, Refuse Access, and Expel
West Flagler Associates reserves the right to cancel any ticket order purchased through its website.
JAM Arena reserves the right to request photo identification from ticket holders.
Any person attending an event who is deemed unmanageable, behaves inappropriately, or fails to comply with JAM Arena policies may be removed from the venue without refund or compensation.
Recording, Transmission, and Publication
All cameras, audio recorders, video recorders, and recording-capable devices are strictly prohibited during events unless expressly authorized by JAM Arena.
By attending an event, you grant West Flagler Associates the irrevocable right to use your image, likeness, actions, and statements captured during the event in any transmission, publication, or reproduction, in any medium, without further authorization or compensation.
Changes in Events
Due to the nature of live events, West Flagler Associates reserves the right to change performers, content, program, or duration without prior notice.
No Resale
Tickets may not be resold, transferred for commercial purposes, or used for advertising or promotional purposes without prior written authorization from West Flagler Associates, except where permitted by law.
Limitation of Liability
NOTWITHSTANDING ANY SECURITY MEASURES IN PLACE, INJURY OR DAMAGE MAY OCCUR DURING AN EVENT. BY ACCEPTING THIS AGREEMENT, YOU ASSUME ALL RISKS, LIABILITIES, AND RESPONSIBILITIES FOR ANY DAMAGES OF ANY NATURE, INCLUDING PERSONAL INJURY, ILLNESS, OR LOSS OF PROPERTY, ARISING BEFORE, DURING, OR AFTER THE EVENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU WAIVE ANY CLAIMS AGAINST WEST FLAGLER ASSOCIATES, JAM ARENA, AND THEIR RESPECTIVE EMPLOYEES, OFFICERS, DIRECTORS, AFFILIATES, AGENTS, AND REPRESENTATIVES.
UNDER NO CIRCUMSTANCES SHALL WEST FLAGLER ASSOCIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
ANY CLAIM ARISING FROM OR RELATED TO THE PURCHASE OR USE OF TICKETS MUST BE FILED WITHIN ONE (1) YEAR OF THE DATE SUCH CLAIM FIRST AROSE. THE MAXIMUM RECOVERABLE AMOUNT SHALL NOT EXCEED THE PURCHASE PRICE OF THE TICKETS.
Assignment
West Flagler Associates may assign its rights and obligations under this Agreement to any affiliated entity without notice, provided such entity assumes all obligations hereunder.
Invalidity
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. Any invalid provision shall be replaced by a valid provision that most closely reflects the original intent.
Alternative Dispute Resolution
In the event of a dispute, you are encouraged to contact JAM Arena directly using the contact information provided on the official website to attempt resolution without litigation.
Applicable Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
